Bug\u00fcn, b\u00fct\u00fcn bir d\u00fcnya hen\u00fcz ad\u0131n\u0131 s\u00f6ylemeye cesaret edemedi\u011fi &#8220;medeniyetsizlik&#8221;<br \/>\ndolay\u0131s\u0131yla ya\u015fad\u0131\u011f\u0131 buhran\u0131n derin sanc\u0131lar\u0131n\u0131 iliklerine kadar hissetmekte, devletler infial ekmekte,<br \/>\ncemiyetler cinnet bi\u00e7mekte. H\u00e2l b\u00f6yle olunca, medeniyet meselesinin bug\u00fcn\u00fc ve aranmas\u0131 gereken zaman<br \/>\nve mek\u00e2n \u00fcst\u00fc niz\u00e2m hakk\u0131nda konu\u015fmak gerekiyor. Bug\u00fcn dilden dile s\u00f6ylenen, tekerleme h\u00e2line<br \/>\ngetirilerek ucuzlat\u0131lan, herkesin bildi\u011fini sand\u0131\u011f\u0131 \u201cBat\u0131 Medeniyetinin \u00c7\u00f6k\u00fc\u015f\u00fc\u201dn\u00fc \u015f\u00f6yle etrafl\u0131ca<br \/>\nincelemeye \u00e7al\u0131\u015fal\u0131m. Meseleyi hem ucuzluktan kurtarmaya gayret edelim, hem de h\u00e2s\u0131l olacak<br \/>\nfark\u0131ndal\u0131\u011f\u0131n bizlere y\u00fckledi\u011fi mesuliyeti idrak edelim.<br \/>\nMuhatab\u0131 oldu\u011fumuz e\u011fitim sistemi bizleri maalesef tekerlemeci ferdler h\u00e2line getiriyor ve yine bu<br \/>\ne\u011fitimden h\u00e2s\u0131l olan pop\u00fcler anlay\u0131\u015f, insan\u0131 di\u011fer varl\u0131klardan ay\u0131ran biricik haslet olan d\u00fc\u015f\u00fcnmek ile<br \/>\ninsan aras\u0131na a\u015f\u0131lmaz perdeler geriyor. Medeniyet mefhumundan yola \u00e7\u0131karak bu perdeyi parampar\u00e7a<br \/>\netmek ve i\u00e7inde bulundu\u011fumuz bu sisli buhranda y\u00f6n\u00fcm\u00fcz\u00fc tayin etmeye \u00e7al\u0131\u015faca\u011f\u0131z. Neye muhatab\u0131z, ne<br \/>\nar\u0131yoruz, ne istiyoruz, asl\u0131nda aranmas\u0131 ve arzulanmas\u0131 gereken ne gibi su\u00e2llere cevab arayaca\u011f\u0131z. Bir<br \/>\ntaraftan da konumuzu i\u015flerken, bug\u00fcn muhatab oldu\u011fumuz Bat\u0131 Medeniyeti ile \u0130sl\u00e2m Medeniyeti<br \/>\naras\u0131ndaki farklar\u0131 da bu ara\u015ft\u0131rma i\u00e7erisinde i\u015faretlemeye \u00e7al\u0131\u015faca\u011f\u0131z.<br \/>\nBahsedece\u011fimiz her bir mefhum kendi ba\u015f\u0131na b\u00fcy\u00fck bir k\u00fclliyat konusu iken burada k\u0131sa alt ba\u015fl\u0131klar<br \/>\nh\u00e2linde yaln\u0131zca kendisini hat\u0131rlatabilecek tarzda ele al\u0131nm\u0131\u015ft\u0131r.<br \/>\n\u201cE\u011fitim sistemi\u201d dedik, \u201cd\u00fc\u015f\u00fcnmek\u201d dedik, \u201cmefhum\u201d dedik&#8230; Dil bir nev\u2019i d\u00fc\u015f\u00fcncenin sureti oldu\u011funa ve<br \/>\nsuret de hakikatin tecellig\u00e2h\u0131 oldu\u011funa g\u00f6re bizim evvel\u00e2 bahsimize konu olan mefhumu, y\u00e2ni medeniyet<br \/>\nmefhumunu a\u00e7\u0131p yerine koymam\u0131z gerekiyor ki, bundan sonra s\u00f6yleyeceklerimizin mihrak\u0131 olarak bir<br \/>\nkenarda bulunsun, ezberci e\u011fitim sisteminin a\u00e7t\u0131\u011f\u0131 yaraya bir mefhum \u00fczerinden de olsa merhem olsun\u2026<br \/>\nMedeniyet<br \/>\nMedeniyet; adaletseverlik, insanca iyi ve ferah ya\u015fay\u0131\u015f. \u015eehirlilik. Ya\u015fay\u0131\u015fta, i\u00e7tima\u00ee m\u00fcn\u00e2sebetlerde, ilim,<br \/>\nfenn ve san&#8217;atta tek\u00e2m\u00fcl etmi\u015f cemiyetlerin h\u00e2li.<br \/>\nS\u00f6zl\u00fck kavram\u0131ndan yola \u00e7\u0131kacak olur ve medeniyetin temel kaidelerini,\u00fczerinden konu\u015fmak \u00fczere<br \/>\ns\u0131ralayacak olursak:<br \/>\nHukuk<br \/>\nAdalet<br \/>\n\u0130ktisad\u00ee anlay\u0131\u015f<br \/>\nFerd ve Toplum<br \/>\n\u0130lim<br \/>\nFenn<br \/>\nSanat<br \/>\n\u2026ve hepsinin ortak paydas\u0131nda yer alan ahl\u00e2k.<br \/>\nMedeniyet mefhumundan yola \u00e7\u0131kt\u0131k ve medeniyetin b\u00fct\u00fcn\u00fcn\u00fc h\u00e2s\u0131l eden bir\u00e7ok mefhum elde etmi\u015f<br \/>\nbulunduk. B\u00fct\u00fcn olan medeniyete nisbetle, b\u00fct\u00fcn\u00fcn kendisini meydana getiren par\u00e7alardan fazlas\u0131<br \/>\noldu\u011funu unutmadan tek tek bu mefhumlar\u0131 inceleyelim\u2026<br \/>\nB-Hukuk<br \/>\nMedeniyet mefhumunun s\u00f6zl\u00fck anlam\u0131nda yer alan ilk kaide adaletseverlik oldu\u011funa ve<br \/>\nMedeniyetin bir y\u00f6n\u00fcn\u00fc i\u00e7tim\u00e2i hayat\u0131n nas\u0131l d\u00fczenlendi\u011fine bakt\u0131\u011f\u0131n\u0131 hesaba katacak olursak, niz\u00e2m\u0131n<br \/>\nsa\u011flamas\u0131 ad\u0131na zorlay\u0131c\u0131 m\u00fceyyidelere ihtiya\u00e7 vard\u0131r. Medeniyet en toplu if\u00e2desiyle belki de niz\u00e2m olarak<br \/>\ntarif edilebilir ve bir niz\u00e2mdan bahsetmek i\u00e7in en ba\u015fta o niz\u00e2m\u0131 sa\u011flayan ve s\u00fcrd\u00fcren hukuk sisteminden<br \/>\nbahsetmek gerekir.<br \/>\n\u0130BDA Mimar\u0131 Salih Mirzabeyo\u011flu &#8220;Hukuk Edebiyat\u0131&#8221; adl\u0131 eserinde hukuku; \u201colmas\u0131 gereken olarak,<br \/>\nahl\u00e2k\u0131n p\u0131ht\u0131la\u015fmas\u0131 ve zorlay\u0131c\u0131 m\u00fceyyideler h\u00e2linde kendi m\u00fcesseseleriyle tecelli eden bir niz\u00e2m&#8221; diye<br \/>\ntarif ediyor.<br \/>\nHukuk mefhumuna bakt\u0131\u011f\u0131m\u0131zda kar\u015f\u0131m\u0131za \u00e7\u0131kan temel soru m\u00fceyyidelerin &#8220;neye nisbetle belirlenmesi<br \/>\ngerekti\u011fidir.<br \/>\nBat\u0131 Medeniyetinin bug\u00fcn icrada olan hukuk kurallar\u0131n\u0131n kayna\u011f\u0131n\u0131 bir i\u015faretleyelim ki ula\u015fmaya<br \/>\n\u00e7al\u0131\u015ft\u0131\u011f\u0131m\u0131z yolda \u00fczerine basaca\u011f\u0131m\u0131z bir basama\u011f\u0131m\u0131z olsun.<br \/>\nBat\u0131 Hukuku: Bat\u0131n\u0131n hukuk anlay\u0131\u015f\u0131n\u0131n R\u00f6nesans D\u00f6neminde \u015fekillendi\u011fini biliyoruz. Charles-Louis<br \/>\nde Secondat, Baron de La Br\u00e8de et de Montesquieu (18 Ocak 1689 \u2013 10 \u015eubat 1755), gibi politik<br \/>\nd\u00fc\u015f\u00fcn\u00fcrlerce Bat\u0131&#8217;n\u0131n hukuk normlar\u0131 \u015fekillendirilmi\u015ftir. Bu hukuk sisteminin temelinde y\u00f6netim bi\u00e7imi<br \/>\nve bu y\u00f6netim bi\u00e7imini teminat alt\u0131na almak \u00fczere in\u015fa edilmi\u015f bir hukuk anlay\u0131\u015f\u0131 h\u00e2kimdir diyebiliriz.<br \/>\nKilise, Krall\u0131k, derebeyli\u011fi d\u00f6nemi \u00fczerine in\u015fa edilen yeni hukuk sistemi, devleti teminat alt\u0131na almak<br \/>\nkayg\u0131s\u0131 \u00fczere kuruludur.<br \/>\nHukuku bir niz\u00e2m olarak tarif etti\u011fimize g\u00f6re Bat\u0131&#8217;n\u0131n hukuk normlar\u0131n\u0131n nisbetini de i\u015faretlememiz<br \/>\ngerekmektedir. Bug\u00fcn uygulamada ems\u00e2li bulunmayan \u0130sl\u00e2m Hukuku&#8217;nun yeniden tesis<br \/>\nedilmesi, Bat\u0131 Medeniyetinin farkl\u0131 formlar h\u00e2linde yeniden tesis etti\u011fi kula kullu\u011fu kald\u0131rmas\u0131 ve<br \/>\ninsanlar\u0131 ger\u00e7ekten birbirlerine e\u015fit k\u0131l\u0131c\u0131 olmas\u0131 bak\u0131m\u0131ndan son derece \u00f6nemlidir. K\u00f6t\u00fc \u00f6rne\u011fin \u00f6rnek<br \/>\nolmayaca\u011f\u0131 d\u00fcsturundan yola \u00e7\u0131karak, yanl\u0131\u015f anlay\u0131\u015flar elinde i\u015fletildi\u011fi iddia edilen \u0130sl\u00e2m Hukukunun, bu<br \/>\ntart\u0131\u015fmada \u0130sl\u00e2m Hukukun tatbiki ad\u0131na ems\u00e2l olmad\u0131\u011f\u0131n\u0131 da il\u00e2ve edelim&#8230;<br \/>\nBug\u00fcne d\u00f6necek olursak, M\u00fcsl\u00fcman olan Anadolu&#8217;da uygulanan hukuk; &#8220;meden\u00ee kanunu \u0130svi\u00e7re&#8217;den,<br \/>\nticaret kanunu Frans\u0131zlar\u0131n s\u00f6m\u00fcrgelerine uygulad\u0131\u011f\u0131 ticaret kanunlar\u0131ndan, ceza hukuku \u0130talya&#8217;dan<br \/>\napar\u0131lan&#8221; ve hukuk \u00fcst\u00fc imtiyazl\u0131 z\u00fcmrenin \u00e7\u0131karlar\u0131yla \u00e7eli\u015filen yerlerde TBMM taraf\u0131ndan yamanan bir<br \/>\nhukuk sistemdir&#8230; B\u0131rak\u0131n M\u00fcsl\u00fcman bir memleketi, d\u00fcnyan\u0131n hi\u00e7bir yerinde b\u00f6yle bir hukuk sistemi in\u015fa<br \/>\nedilemez ve b\u00f6yle bir hukuk sistemi niz\u00e2m\u0131 de\u011fil, kaosu davet eder. Kaostan kendi kendine niz\u00e2m<br \/>\ndo\u011fmayaca\u011f\u0131na g\u00f6re bug\u00fcn ya\u015fanan iti\u015f kak\u0131\u015flar\u0131n da kendi ba\u015f\u0131na bir yere varmayaca\u011f\u0131, ekmekten sudan<br \/>\n\u00e7ok, yeni bir d\u00fcnya g\u00f6r\u00fc\u015f\u00fcne, bize ait olan bir d\u00fcnya g\u00f6r\u00fc\u015f\u00fcne muhta\u00e7 oldu\u011fumuz art\u0131k anla\u015f\u0131lmal\u0131d\u0131r.<br \/>\nC-Adalet<br \/>\nMedeniyetin temel g\u00f6stergesinin niz\u00e2m oldu\u011funu ve niz\u00e2m\u0131n sa\u011flanmas\u0131 i\u00e7in zorlay\u0131c\u0131 m\u00fceyyidelere,<br \/>\nhukuk kurallar\u0131na ihtiya\u00e7 oldu\u011funu if\u00e2de etmi\u015ftik. Hukuk kurallar\u0131n\u0131n bir kenarda varl\u0131\u011f\u0131 tek ba\u015f\u0131na bir<br \/>\nanlam ta\u015f\u0131mayaca\u011f\u0131na g\u00f6re bu kurallar\u0131n tatbik edilmesi gerekir.<br \/>\nAdalet; hukuk kurallar\u0131 bir kenara konduktan sonra, kendi ba\u015f\u0131na adaleti sa\u011flayamayaca\u011f\u0131 i\u00e7in adaleti<br \/>\nsa\u011flayacak vicdanlara ihtiya\u00e7 do\u011far.
